National Business Support Unit - Non Statutory Provided Services

As part of a HSE wide initiative to improve governance arrangements for the funding of  Non-Statutory Agencies, a national framework has been developed which will ensure a consistent approach.

This Framework seeks to provide a level of governance, which will link funding provided to a quantum of service, and provides for these services to be linked to quality standards, with continuous monitoring to ensure equity, efficiency and effective use of available resources.

A critical element of the Framework is the use of standard documentation to formalise the funding arrangements. This documentation is available for download under the following headings.

 

Section 38 Documentation

Section 38 documentation relates to the Agencies being provided with funding under Section 38 of the Health Act, 2004. This is limited to 25 non-acute agencies and 16 voluntary acute hospitals currently within the HSE Employment Control Framework.

Non-Acute /Community Section 38 Generic Schedule (Revised Jan 2012) This document is part 2 of a 2 part legal contract for Non-Acute/Community Agencies funded under Section 38, this provides a standard template for 10 schedules which will detail the individual specification of each arrangement. Section 39 Documentation

Section 39 documentation relates to Non-Acute/Community Agencies being provided with funding under Section 39 of the Health Act, 2004. This relates to all agencies with the exception of the 41 agencies funded under Section 38. The Framework allows for a tiered approach to the level of governance and separate documentation is used for agencies in receipt of funding above/below €250,000.

Grant Aid Agreement (Revised Jan 2012) This document is the legal contract for Non-Acute/Community Agencies funded under Section 39 in receipt of funding below the €250,000 threshold.

 

Section 10 Documentation

Section 10 documentation relates to the Non-Acute/Community Agencies being provided with funding under Section 10 of the Child Care Act, 1991. This Framework allows for a tiered approach to the level of governance and separate documentation is used for agencies in receipt of funding above/below €250,000.

National Lottery Documentation

Agencies funded under the National Lottery are required to sign a standard Grant Aid Agreement where funding is below the annual threshold of €250,000.

Letter of Undertaking - National Lottery Capital Funding This document is a letter of Undertaking for agencies in receipt of National Lottery funding which is used for Capital purposes.

 

For-Profit Documentation

For-Profit documentation relates to For-Profit / Commercial agencies funded by the Health Service Executive for Health, Personal & Social services. Under the Framework a Service Arrangement should be used irrespective of funding.

Home Care Package Documentation

The conclusion to the national tender for home care packages represents a significant milestone in the continued development of the HSE’s relationship with the non statutory sector in the provision of personal health and social services.

The HSE’s statutory obligation to provide for the nation’s health care needs while ensuring it meets it’s responsibility with regard to quality standards and value for money have been greatly strengthened by the process.

The services which will be provided by the successful agencies can be assured as being to the best quality standard, targeted at those assessed as being in the greatest need, and at agreed national tariffs.  

The application now of the national standard governance documentation should ensure that the loop is completed and the agencies are contractually committed to the terms of the agreement.

Home Care Package Approved Provider Monthly Return Template This template is used to capture Home Care Package information from Approved Providers on a monthly basis.

 

Application and Negotiation Process

A standard application and negotiation control process exists within the HSE Governance Framework for Non-Statutory Agencies. This process is utilised in situations whereby the HSE decides to provide funding to a voluntary/non-statutory agency in relation to health and personal social services. Two relevant standard processes need to be worked through by HSE Managers depending on whether or not the funding to an organisation is above or below €50,000.

Documentation has been prepared to support these control processes including Flowcharts, Guides and accompanying Forms. These are available for download below.

   
Application Form for Funding This is the standard HSE application form to be completed by all non-statutory organisations applying to the HSE for funding in relation to the delivery of health or personal social services.
Supplementary Supporting Information Form (SSI Form) This is the standard HSE form to be completed by an organisation where the HSE has received an application form and requires additional information in order to make a decision on funding where the amount involved is over €50,000.
Supplementary Information Staffing Template This is an Excel template used to capture detailed staffing information relevant to a proposed service.
Governance Self Evaluation Questionnaire This questionnaire provides an overview of a broad range of governance issues relating to a proposed service and provides the organisation with a tool to assess the adequacy of it's governance structures and processes.

Documentation has been prepared to support the Complaints process between the HSE and Non-Statutory Agencies. These are available for download below.

Review of Documentation January 2012

A review of all documentation took place in 2011, which resulted in some updates in the standard documentation for use from January 2012.

In addition to updating the existing documentation, a national standard Commercial "For-Profit" Service Arrangement has been created and is now included in the available suite of documentation in the Governance Framework.

Schedule 3 Amalgamation Template (Excel) Disability Agencies

This template provides instruction on the amalgamation of 2012 Schedule 3 templates for Disability agencies. It can be used in the following instances:

  • to combine local schedules for a national agency
  • to combine Service Providers in a HSE Area
  • to combine all Areas in a HSE region
  • to combine all HSE Regions Nationally
Schedule 3 Template (Excel) Children-Families Early Years Service Specification This template is for use within the Children & Family Care Group for specification of information on Early Years Services.
Schedule 3 Template (Excel)- Basic Input Sheet for Service Specification Quantum This template is for use in all other Care Groups (Excl. Disabilities) where the activity information required for Schedule 3 would benefit from an excel format.
Schedule 3 Template (Excel) - Resource Allocation Model Generic This template may be used where a detailed costing to a service unit is required. It requires the input of Whole Time Equivalant (WTE) staffing and provides automatic calculations for salaried costs. Acute Schedule 2 Quality and Safety Development Plan Template This template is for use by Acute hospitals when developing their Quality & Safety Development Plan as per Schedule 2 requirements.
